Article 1 : Application fields and modification of terms of sale
These terms of sale apply to every order placed on the website www.katimaa.com.
The company LA MAISON DE L’ARGAN is responsible for the sale of Katima’A products. The company LA MAISON DE L’ARGAN (as written below LA MAISON DE L’ARGAN) keeps the right to adapt or change these terms of sales anytime. In the event of modification, terms of sale in force at the date of order will be applied.
Article 2 : Products characteristics and availability
In accordance with the article L. 111-1 of the consumption law, the buyer can read the main characteristics of the product(s) he/she wants to buy on Katima’A website before ordering anything.
The buyer chooses one or several products among all the categories proposed on Katima’A website.
Our product’s proposal and prices are valid as far as they are present on the website, upon receipt of the order, we check good(s) is (are) available from stock.
In case of unavailability, we undertake, within 30 days from the order validation by the buyer, whether to send him/her the ordered product or to reimburse her/him.
In the event of one of the ordered products is out of stock, we will send the back order.
The date of the order validity corresponds to the date of the order and online payment by credit card.
The photography, graphics and descriptions of the products sold on this website are only indicative and do not bind the seller.
Article 3 : Order validation and electronic signature (law of the 13th of March 2000 about electronic signature)
All order-taking which is validated by clicking on the button « valid your order» constitutes a binding acceptance which can only be questioned into the limits of these terms of sales.
Clicking on the button “valid your order”, combined with authentication and non rejected procedure and with the protection of the integrity of the messages, is considered as an electronic signature. This electronic signature is valid between the buyer and the seller as a hand signature would have been.
Article 4 : Prices
LA MAISON DE L’ARGAN can change prices anytime but commits to apply the current prices that are indicated when the buyer takes an order, and if goods are available in stock at this time.
Article 5 : Terms of payment and security
- Terms of payment :
The settlement is online payment with a credit card (Visa, Mastercard). The payment entered the secure bank server of our bank partner CREDIT AGRICOLE. This means that no bank information is transferred through katimaa.com website. Therefore, payment by credit card is totally secure. The order will be recorded and validated from the acceptance of the payment by the bank of the buyer.
- Security :
The information of credit cards are encrypted thanks to the Secure Socket Layer process and do not transit clearly on the network. Payment is directly made to the bank. LA MAISON DE L’ARGAN has no access to these information and do not keep them on its servers. That is why that information has to be filled in for each transaction on our website.
- Default in payment :
LA MAISON DE L’ARGAN can refuse to deliver products or meet an order made by a consumer who has a payment contention with LA MAISON DE L’ARGAN.
- Property :
The products remain the property of LA MAISON DE L’ARGAN until complete cashing of the order by LA MAISON DE L’ARGAN. Still from the delivery time (package confided to post service), the risks of delivered merchandise are transferred to the customer.
- Fraud control :
LA MAISON DE L'ARGAN controls all the orders which were validated on its website. These controls aim at protecting LA MAISON DE L’ARGAN from improper practices made by fraud people.
Within these procedures, our sale department can ask you for all necessary information so as to release your order: proof of address, invoices, etc… These requests are sent by e-mail, then by registered letter with signed receipt. The information written on the purchase order is submitted to automated data processing. This automated data processing aims at defining a level analysis for a transaction and fights against credit cards fraud.
The non-transfer of data from your purchase order stops the achievement and the analysis of your transaction. If there is a non-payment caused by fraud use of a credit card, this fraud will lead to the registration of the purchase order data into a “default in payment file”. A misstatement or an irregularity can also be submitted to a specific processing.

Article 6 : Method of delivery and delivery date
- General :
The products are delivered to the address that you fill in during the online order procedure, in every listed country.
For order follow-up reason, we cannot deliver order in army headquarters.
- Expenses :
Postage and packing charges of the order are inclusively billed before the validation of your order. In case of many shipments (products out of stock), this participation to processing charges would only be billed once.
- Time before shipping :
All announced delivery dates are calculated considering working days. Delivery dates are average delivery dates and correspond to processing, preparation and expedition time of your order from our bonds. But post delivery time has to be added to this delivery date. Each available product is sent within 5 days depending on the country.
- Delivery date :
The ordered product is delivered by post (Colissimo Expert International), to the address which appears on the purchase order.
Delivery times will vary according to the destination. LA MAISON DE L’ARGAN cannot be held responsible for any delays in delivery.
Delayed delivery cannot give rise to any penalty or indemnity, and cannot be used as reason for cancelling the order.
- When you receive products :
If at the delivery time, the original packing is faulty, torn, opened, the buyer has to check the good condition of the merchandise packaging and content when the postman is still present. If they have been damaged, he/she has to imperatively reject the package and write a reservation on the delivery note (“opened or damaged package”). Then, the buyer has to send an e-mail (email@example.com) or a post mail with reservations at last 3 days after the receipt of the product(s) at the following address LA MAISON DE L'ARGAN – KATIMA’A - Service Clients litiges livraison - B.P. 70 – 33041 BORDEAUX CEDEX – FRANCE.
If the products have to be sent again to the customer, the buyer has to ask for returning procedure to our Customer Service in a 7 days time limit from the delivery date. Every complaint formulated after this time limit cannot be accepted.
Products can only be returned if they are in their original condition (packing, accessories, leaflet). Upon receipt of the product and checking of damages, we will exchange or reimburse it, according to the consumer. This last must not throw away the products.
Article 7 : Responsabilities
LA MAISON DE L'ARGAN is not responsible for the non-execution of the contract if the product is out of stock or if the product is unavailable due to a force majeure event, a disturbance, partial or all-out strike, in particular post mail or transport and or communication strikes.
LA MAISON DE L'ARGAN cannot be responsible for non direct damages caused by the purchase of the products.
In case of partial or no delivery of an order, the buyer has six months time limit maximum (from the date of collection of the goods in our bonds) to come forward. Beyond this time limit, we will not accept any complaint.
Article 8 : Order cancellation
In accordance with the article L. 121-16 and following articles of the Consumption Law, the consumer has 7 days time limit from the delivery date of his/her order to return each product that is not suitable and ask for exchange or reimbursement without penalty, except post mail charges. The buyer has to get an agreed number for return, before returning the product (see paragraph 9, returning procedure). The non-used product would have to be returning in good condition, wrapped in its original packaging.
Post mail charges in the event of rejected product are customer’s charges. In case of rejected product, we won’t accept the product return if it is not wrapped in its original packaging. We will send back the package to the buyer and will inform him/her by electronic mail.
Discount or non stocked goods on the website cannot be returned nor exchanged except in case of latent defects.
Article 9 : Possibility of returning the good
- Returning procedure :
Upon receipt of the box, the buyer has 7 days time limit to warn the Customer Service of LA MAISON DE L’ARGAN about his/her decision to return the product. From the date of returning request, the buyer has to send back the product within 15 days. This condition is not applied if returning cause consists in defect or non-conformity of the product.
A preliminary request to Customers’ Service has to be done so as to get an agreed number for return. No package will be accepted and handled without this number.
Article 10 : Applicable law and competent jurisdiction
The products’ sales of the company LA MAISON DE L’ARGAN are subjected to French law. Every contention due to interpretation, fulfillment or breach of contract clinched between LA MAISON DE L’ARGAN and the buyer, even in case of many defense lawyers, will be assigned, if no amicable agreement is found, to the skills of Paris law court.
Anytime, you can comply with, modify, correct and suppress your datas (art. 34 of the French law “Informatiques et Libertés” of the 6th of January 1978 ).
